Crystal scores molecule win over Syngenta

India (SANEPR.com) July 24, 2009 -- In a landmark decision Hon’ble Delhi High Court, standing with the domestic agrochemical Industry dismissed a controversial claim by Swiss agrochemical giant Syngenta, that Govt. of India should not grant Emamectin Benzoate 5% SG to Indian company Jaishree. (Presently known as Crystal Phosphates Ltd.). Hon’ble Justice Mr. S. Ravindra Bhat ruled that litigation filed by Syngenta was speculative. In addition to this the court also penalized Syngenta to bear third respondents (crystal Phosphates Ltd) cost for hearings, quantified at Rs. 75,000/- per hearing.

According to the petitioner Syngenta India Ltd, it had writ petition under Article 226 of the constitution of India impugns the decision of the Union Department of Agriculture, dated 5-11-2008, rejecting its appeal under section 10 of the insecticides Act, 1968 against the decision of the registration Committee to granting for Emamectin Benzoate 5% SG to the third respondent (Crystal Phosphates Ltd.) in its 293rd meeting held on 26.09.2008.

But Hon’ble court found that the above mentioned litigation was speculative, as the attempt was clearly to invite the court to make a policy declaration, which could not have been made under any circumstances. The pendency of the court proceedings has also resulted in prejudice to the third respondents (Crystal Phosphates Ltd.). Thus the court dismissed the petition of Syngenta.

This judgment is a major setback for Syngenta as they were offering disputed molecule at very higher price and it is very obvious that Crystal Phosphate will deliver the same molecule at very lower price. This will end monopoly of Syngenta and Indian farmers will be beneficiary as they will pay lesser prices.

Commenting on the Judgment Mr. N K Aggarwal, Chairman, Crystal Phosphates Ltd. said,” Actually this decision is in favor of Indian farmers. It’s a known fact that MNCs are exploiting Indian farmers by selling their products at very high prices. Now after winning this case we can assure our farmers that we will offer the same molecule at very affordable price.”

Mr. N K Aggarwal also assured the Indian Agriculture industries and Indian farmers that he will always fight for the welfare of farmers and industries and deal with government reforms in rules and regulation

It is also expected that this ruling will be an eye opener to other MNCs as they have had a regular tendency to avoid competition from domestic players so that they can monoploise the market and then sell their products at higher prices.

Crystal Phosphates Ltd. has from the very beginning asserted that by creating hurdles for Crystal Phosphates Ltd., Syngenta wants to dominate Indian Agriculture and to exploit Indian farmers. As such, this ruling by the honorable Delhi High Court has vindicated Crystal Phosphates Ltd.
